Welcome to AnyTale ("Platform"), operated by ANYTALE LLC ("Company," "we," "us," or "our"). By accessing or using the Platform, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform.
You must be at least 13 years old to use AnyTale. By using the Platform, you represent and warrant that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to protect your credentials.
Any content you create, upload, or otherwise make available through the Platform ("User Content") remains yours. However, by submitting User Content, you grant AnyTale LLC a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content in connection with operating and providing the Platform.
You are solely responsible for your User Content. You agree not to upload, post, or otherwise transmit content that:

We strive to maintain the availability of the Platform but do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue the Platform or any part thereof at any time without notice.
All materials and services provided by AnyTale, including but not limited to software, logos, and designs (excluding User Content), are owned by ANYTALE LLC or its licensors and protected by intellectual property laws.
THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYTALE LLC DISCLAIMS ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
ANYTALE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless ANYTALE LLC and its affiliates, officers, agents, employees, and partners from and against any claim, liability, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Platform or violation of these Terms.
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the federal or state courts located within Bernalillo County, New Mexico, and you consent to personal jurisdiction and venue in these courts.
We reserve the right to modify these Terms at any time. We will provide notice of material changes, and your continued use of the Platform after such changes will constitute your acceptance of the updated Terms.
